1. General

Fixclinic is a trading name of Mibu Pty Ltd (“we”, “us”, “our”).
By booking an appointment, purchasing a product or service, or using our website, you (“you”, “the client”) agree to these Terms & Conditions.

These Terms apply to all services provided by Fixclinic unless otherwise stated in writing.

2. Services Provided

Fixclinic provides rehabilitation, recovery, wellness, and performance-based services, which may include but are not limited to:

PEMF therapy

Cryotherapy

Activation and recovery therapies

Strength, conditioning, and movement-based services

Our services are not a substitute for medical diagnosis or treatment unless explicitly stated.

3. No Medical Advice

Unless explicitly stated otherwise:

Fixclinic does not provide medical, physiotherapy, or diagnostic services

Information provided during sessions is general in nature

You are responsible for seeking medical clearance where required

Participation in services is voluntary and at your own risk.

4. Client Responsibilities

You agree to:

Provide accurate and complete health information

Disclose any medical conditions, injuries, or contraindications

Follow all instructions provided by staff

Stop a session immediately if you feel pain, discomfort, or distress

Failure to disclose relevant information may increase risk and void liability protections.

5. Bookings & Appointments

Appointments are subject to availability

Late arrivals may result in reduced session time

Missed appointments may be charged in full

Specific cancellation timeframes may be communicated at the time of booking.

6. Payments

Payment is required as advised at the time of booking or purchase

Prices are subject to change without notice

All payments must be made in full prior to or at the time of service unless otherwise agreed

Unpaid balances may result in refusal of future services.

7. Refunds

To the extent permitted by law:

Services are non-refundable once delivered

No refunds are provided for change of mind

Unused prepaid sessions may expire if not used within the agreed timeframe

Gift Vouchers
Gift vouchers are non-refundable and cannot be redeemed for cash.
Vouchers are valid for a minimum of three (3) years from the date of purchase unless otherwise stated.
Refunds or replacements will only be provided where required under Australian Consumer Law.

8. Assumption of Risk & Waiver

You acknowledge that participation in recovery and performance services involves inherent risks, including but not limited to:

Muscle soreness or strain

Fatigue

Temporary discomfort

Exacerbation of existing conditions

You voluntarily assume all risks associated with participation.

9. Limitation of Liability

To the maximum extent permitted by law:

Fixclinic and Mibu Pty Ltd are not liable for any injury, loss, or damage arising from participation

Liability is limited to the re-supply of services where required under Australian Consumer Law

Nothing in these Terms excludes rights that cannot be excluded by law.

10. Privacy

Your personal information is handled in accordance with our Privacy Policy, which forms part of these Terms.

11. Intellectual Property

All content, programs, materials, and branding remain the property of Mibu Pty Ltd and may not be reproduced without written consent.

12. Termination of Services

We reserve the right to refuse or discontinue services if:

Safety is compromised

Behaviour is inappropriate or abusive

Payment obligations are not met

13. Governing Law

These Terms are governed by the laws of New South Wales, Australia.
Any disputes will be subject to the jurisdiction of NSW courts.
